Ten workplace rights

• 1. You have the right to be paid

  Your immigration status does not matter. Even if you are undocumented, if you have worked you have the right to be paid.

• 2. Minimum wage

  You must be paid at least the minimum wage for all regular hours worked.

• 3. Criminal-history questions

  Your employer may not ask about arrests or convictions on job applications and may not run a background check or ask about criminal records until after making a conditional offer of employment.

• 4. Overtime

  You must be paid overtime if you work more than 8 hours in a day or more than 40 hours in a week.

• 5. Meal breaks

  Your employer must give you a 30-minute unpaid meal break for every 5 hours of work.

• 6. Rest breaks

  Your employer must give you a 10-minute paid rest break if you work a shift of 3.5 to 6 hours, and two rest breaks if you work a shift of 6 to 10 hours.

• 7. Tips

  Tips are your property. Your employer may set up tip pooling only if it is reasonable and shared by employees who provide service.

• 8. Vacation

  Vacation pay is not required by law. If it is provided, unused vacation must be paid when you leave.

• 9. Paid sick leave

  After 90 days on the job you have the right to paid sick leave. You do not have to miss a full shift. You can use a few hours at a time, for yourself or a family member, or to care for another person.

• 10. Final pay and no retaliation

  Your employer must pay all wages due, plus remaining vacation, immediately on discharge or resignation. You have other rights too. Your employer cannot fire or punish you for exercising them — for example, asking for a sick day or organizing coworkers. If they do, contact us.
